“Defendant’s arguments regarding the jury instructions, while certainly well preserved, do not demonstrate a serious miscarriage of justice,” U.S. District Judge Carl Nichols, who presided over Bannon’s trial, wrote in a ruling Friday. Bannon had also asked the judge to dismiss the case against him because Bannon was prevented from compelling various lawmakers — including members of the House Select Committee — to testify at his trial. “Defendant has not shown that the testimony of any member of the House of Representatives he sought would be material,” Nichols wrote. Bannon is expected to be sentenced on October 21 and faces at least 30 days in jail.
